commercial or unlawful purposes from other Users; - impersonate any person or entity (including Public Speaking Community
employees or Forum guests or hosts) or misrepresent any affiliation
with any person or entity; - involves commercial activities and/or sales without our prior
written consent such as contests, sweepstakes, barter, advertising, or
pyramid schemes; - includes a photograph of another person that you have posted
without that person's consent;

Access to certain contents on Public Speaking Community may be subject to a
fee. All payments must be made in advance in Australian Dollars unless
specified, and do not include GST. All transactions are made in
Australian Dollars. Members are responsible for the payment of all
charges associated with the use of the Public Speaking Community website. - Membership
If the web master terminates your use of the Site, you will be
not entitled to receive a refund of any credits or pre-payments, which
remain unused at the time of termination. You will continue to be
responsible for any fees or other charges incurred by you prior to such
termination.
You acknowledge that Public Speaking Community reserves the right to charge for the
subscriptions and to change its fees from time to time in its
discretion. - Password
When you sign up to become a Member, you will be sent a
password. You are entirely responsible for maintaining the
confidentiality of your password. You agree not to use the account,
username, or password of another Member at any time or to disclose your
password to any third party. You agree to notify Public Speaking Community
immediately if you suspect any unauthorized use of your account or
access to your password. You are solely responsible for any and all use
of your account. - Copyright Policy
You may not post, modify, distribute, or reproduce in any way
any copyrighted material, trademarks, or other proprietary information
belonging to others without obtaining the prior written consent of the
owner of such proprietary rights.
It is the policy of Public Speaking Community to terminate Membership privileges of
any Member who repeatedly infringes the copyright rights of others upon
receipt of proper notification to Public Speaking Community by the copyright owner
or the copyright owner's legal agent. Without limiting the foregoing,
if you believe that your work has been copied and posted on the Public Speaking Community Website in a way that constitutes copyright infringement, please
provide our web master with the following information:
(i) an electronic or physical signature of the person authorized
to act on behalf of the owner of the copyright interest;
(ii) a description of the copyrighted work that you claim has been
infringed;
(iii) a description of where the material that you claim is infringing

Notwithstanding anything to the contrary contained herein, Public Speaking Community's liability to you for any cause whatsoever and regardless of
the form of the action, will at all times be limited to the amount
paid, if any, by you to Public Speaking Community, for the services during the term
of membership. - Disputes
If there is any dispute about or that involves Public Speaking Community in
any way, users agree that the dispute shall be governed by the laws of
Australia without regard to conflict of law provisions and users agree
to exclusive personal jurisdiction and venue in Australia. - Indemnity
Users agree to indemnify, defend and hold Public Speaking Community, its
directors, employees, officers, affiliates, agents, partners,
licensors, suppliers and any third party providers, from any loss,
liability, claim, demand, including reasonable attorneys' fees,
resulting from violations of this Agreement and/or arising from a
breach of this Agreement and/or any breach of their representations and
warranties set forth above and/or if any content posted on the Public Speaking Community website causes Public Speaking Community to be liable to another - Security Capabilities
Public Speaking Community guarantees the use at all times of a Secure Socket
Layer (SSL) of 128-bit encryption or higher, or 3D Secure (Verified By
Visa and MasterCard Secure Code) to establish a secure browser session
between Public Speaking Community and Users when receiving cardholder information
via the internet. - Privacy Policy and Personal Information
Public Speaking Community does not collect any personal information about you
through this website unless you provide that information voluntarily by
sending an email, responding to a survey, or registering on the website
by completing an online form. When you visit Public Speaking Community website our
servers automatically collect and store information about your visit,
which is collected for the purposes of creating summary statistics that
assist us to make our site more useful to Users. No attempt will be
made to identify Users or their browsing activities except, in the

Agreement constitutes the entire agreement between you and Public Speaking Community
regarding the use of the Public Speaking Community Website. The failure of Public Speaking Community to exercise or enforce any right or provision of this Agreement
shall not operate as a waiver of such right or provision. The section
titles in this Agreement are a basic guideline only and have no legal
or contractual effect. This Agreement operates to the fullest extent
permissible by law. If any provision of this Agreement is unlawful,
void or unenforceable, that provision is deemed severable from this
Agreement and does not affect the validity and enforceability of any
remaining provisions.

The following is a partial list of the kind of activity that is
illegal or prohibited on Public Speaking Community and through your use of the
website. Public Speaking Community reserves the right to investigate and take
appropriate legal action against anyone who, in Public Speaking Community's sole
discretion, violates this provision, including without limitation,
reporting you to law enforcement authorities. Prohibited activity
includes, but is not limited to:
criminal or tortious activity, including child pornography, fraud,
trafficking in obscene material, drug dealing, gambling, harassment,
stalking, spamming, spimming, sending of viruses or other harmful
files, copyright infringement, patent infringement, or theft of trade
secrets;
advertising to, or solicitation of, any Member to buy or sell any
products or services. You may not transmit any chain letters or junk
email to other Members.
It is also a violation of these rules to use any information
obtained from the Public Speaking Community to contact, advertise to, solicit, or
sell to any Member without their prior explicit consent.
If you breach this Agreement and send unsolicited bulk email,
instant messages or other unsolicited communications of any kind
through the Public Speaking Community Website you acknowledge that you will have
caused substantial harm to Public Speaking Community and other members, but that the
amount of such harm would be extremely difficult to ascertain. As a
reasonable estimation of such harm, you agree to pay Public Speaking Community for
each such unsolicited email or other unsolicited communication you send
through the Public Speaking Community Website;
any automated use of the system, such as using scripts to add friends
or send comments or messages;
using the account, username, or password of another Member at any time
or disclosing your password to any third party or permitting any third
party to access your account;
selling or otherwise transferring your profile;
using any information obtained from the Public Speaking Community Website to harass,
abuse, or harm another person;
displaying an advertisement on your profile, or accepting payment or
anything of value from a third person in exchange for your performing
any commercial activity on or through the Public Speaking Community website on
behalf of that person, such as placing commercial content on your
profile, posting blogs or bulletins with a commercial purpose, or
sending private messages with a commercial purpose; or
using the Public Speaking Community Website in a manner inconsistent with any and
